Terms & Conditions

These Terms & Conditions define the mutual rights and obligations between Himalay’Art and its clients regarding the online sale of handcrafted artworks and exceptional artisan pieces created in Nepal.
Each piece presented by Himalay’Art is the result of the ancestral know-how of Nepalese artists and master craftsmen, made in full respect of the cultural traditions of the Kathmandu Valley.

2. Purpose

These Terms & Conditions govern the sale of artworks and handcrafted objects offered by Himalay’Art, including:

  • Bronze or wood sculptures,

  • Thangkas (traditional paintings),

  • Hand-hammered singing bowls.

Each piece is unique and handmade; therefore, slight variations in shape, patina, color, or finish may occur compared with the photographs shown. Such natural differences are an integral part of the authenticity of the artwork and cannot be considered defects.


3. Orders

Placing an order on www.himalayart.com implies full and unconditional acceptance of these Terms & Conditions.
The client agrees to provide accurate and complete information. Himalay’Art cannot be held responsible for delays or delivery issues caused by incorrect or incomplete information.

Himalay’Art reserves the right to refuse any order that appears abnormal, fraudulent, or originates from a client involved in a previous dispute.


4. Prices and Taxes

All prices are listed in euros (€).
They include French VAT (TTC) for sales within France and the European Union.

  • Original artworks: VAT at 5.5%

  • Decorative or handcrafted objects: VAT at 20%

For deliveries outside the European Union (e.g., Switzerland, Canada, Japan, USA), prices are shown excluding taxes.
Customs duties, import taxes, or handling fees may be charged by local authorities upon arrival. These costs are the buyer’s responsibility.


5. Payment

Payments can be made by:

  • Credit or debit card via the secure Shopify Payments platform,

  • PayPal,

  • Bank transfer (details provided upon order confirmation).

Orders are confirmed only after full payment has been received.
All artworks remain the property of Himalay’Art until payment has been made in full.


6. Shipping and Delivery

Shipments are made from either France or Nepal, depending on the item’s storage location.
Carriers may vary according to the destination (such as DHL, FedEx, Jetivia, or other specialized logistics partners).

Orders are generally prepared and shipped within 1 to 5 business days after payment confirmation, except during exceptional circumstances.
Delivery times vary depending on the carrier and destination.

Each artwork is carefully inspected and securely packaged before shipping to ensure its safe arrival.
Himalay’Art cannot be held responsible for delays caused by transport services or customs procedures.


7. Right of Withdrawal and Returns

In accordance with EU law (Article L221-18 of the French Consumer Code), clients have a 14-day withdrawal periodstarting from the date of receipt, without the need to provide any reason.
Himalay’Art extends this period to 21 days as a gesture of goodwill.

Return conditions:

  • The item must be returned in its original condition and packaging, without alteration or damage.

  • The invoice or proof of purchase must be included.

  • Return shipping costs are at the client’s expense.

  • For complete returns, the initial delivery fee (at the standard rate) will be refunded.

Refunds will be processed within 10 business days of receiving and verifying the returned item.

Exceptions:
As per Article L221-28 of the French Consumer Code, custom-made or specially ordered pieces (e.g., certain statues, gold leaf gilding, or commissioned artworks) cannot be returned or refunded, except in the case of a proven defect.


8. Warranty and Liability

All artworks offered by Himalay’Art receive the highest level of attention in their creation, selection, and packaging.
However, Himalay’Art cannot be held liable for any damage or alteration resulting from:

  • improper handling or misuse,

  • insufficient maintenance,

  • or events beyond its control (transport delays, natural disasters, customs blocks, strikes, etc.).

As each piece is handcrafted, minor variations are inherent to its nature and contribute to its authenticity.


9. Personal Data

Personal data collected during the ordering process is used exclusively for order processing, delivery, and customer relations, in accordance with the Privacy Policy available on the website.
Clients may request access, correction, or deletion of their data at any time by contacting: galentarnaud@hotmail.com


10. Governing Law and Dispute Resolution

These Terms & Conditions are governed by French law.
In the event of a dispute, both parties will seek an amicable resolution in good faith.
If no agreement is reached, the dispute shall be brought before the competent French courts.


11. Commitment and Values

Himalay’Art is committed to providing each client with an experience based on trust, authenticity, and respect for traditional craftsmanship.
Every purchase contributes to preserving the cultural heritage of Nepal and directly supports its artists and master craftsmen.
